Remarkable step by Child Welfare Committeee Sanskar Ashram Delhi

Children studying in Municipal & Government schools and their parents from North East district of Delhi have made hundreds of complaints with Delhi Commission for Protection of Child Rights (DCPCR) and Education Department regarding lack of sanitation, drinking water etc. in their schools. But these complaints are lost somewhere in the heaps of files in DCPCR and Department. Once or twice DCPCR sent a letter that school has taken action on your complaint and DCPCR get satisfied with action on paper, whereas the situation on ground remains the same.

In New Seema Puri there is a Municipal Corporation School Building in which three schools run in two shifts and approximately 4000 children are studying in these three schools. There are toilets constructed in all floors of the school building but since August 2014 all toilets were blocked due to blockage in main sever line of the school. The situation was so terrible that toilet blocks were over flown and waste from toilet comes to the class rooms.

Principals of all these three schools have not only written several request to their senior officials to clear the blockage of sewer line whereas they also met personally and briefed about the worst condition of the school. More than four months passed but no action has been taken by the department to clear the blockage of sever line.

Knowing the fact that DCPCR is not doing proper disposal of complaints, therefore parents and SMC members have filed the complaint with Child Welfare Committee (CWC), Sanskar Ashram on 12/12/2014 and requested to take action on this.

CWC, Sanskar Ashram has taken cognizance immediately on the complaint and issued notice to Education Director, East Delhi Municipal Corporation and directed him to appear personally on 22/12/2014 to give explanation about action taken on the issue. As soon the notice served we have noticed miracle the very next day. The whole department was in the school and they were engaged in the work of clearing the blockage of sewer line. During the clearance of sewer line two trucks of garbage have taken out from sewer.

We welcome this remarkable step taken by Child Welfare Committee and request DCPCR to learn how a quasi judicial body act in the best interest of children.






Directorate of Education (DOE) has started hearing under GR mechanism

Many children studying in schools run by Delhi government have filed written complaint before Deputy Director of Education (DDE) against lack of basic facilities like improper sitting arrangements, drinking water, lack of toilets, sanitation etc. in their school. They have registered their complaints by using Grievance Redressal Mechanism established by DOE under provision of Sec 32 of RTE Act.

On the basis of these complaints DDE has appointed an Investigation Officer (IO) to investigate the matter. Today the appointed IO has called these children for hearing. During the hearing these children has given their statements before the IO.

In earlier Education Department never followed the process of hearing on complaints. DOE always disposed off the cases in a closed room without any inquiry and without giving opportunity of hearing to aggrieved person. Time to time we have regularly made strong opposition. Now they have started the hearing process and it is a welcoming step by DOE. We hope now DOE will take action as per statement of these children.

Delhi Commission of Protection of Child Rights (DCPCR) is habitual to dispose off the cases without any inquiry and hearing opportunity and act like a postman on RTE grievances. So DCPCR should learn from this.





दिल्ली के Additional District Magistrate (ADM) सुनेंगे राशन से जुड़ी शिकायतें




यदि आपको राशन नहीं मिल रहा है, आपका राशन कार्ड नहीं बन पा रहा है, राशन कार्ड का आवेदन जमा नहीं हो पा रहा है या राशन विभाग का अधिकारी आपकी राशन से संबन्धित समस्या को नहीं सुन रहा है तो नई व्यवस्था के तहत आप अपनी शिकायत अपने जिले के Additional District Magistrate (ADM) के पास लिखित में कीजिये। राष्ट्रीय खाद्य सुरक्षा कानून (NFSA) के तहत दिल्ली के माननीय उपराज्यपाल महोदय नें दिल्ली के सभी ADM को जिला शिकायत निवारण अधिकारी (District Grievance Redressal Officer - DGRO) नियुक्त किया है। इस व्यवस्था के मुख्य बिन्दु इस प्रकार हैं:
ADM कार्यालय आपकी शिकायत को जमा लेगा, उसे रजिस्टर कर आपको शिकायत रेजिस्ट्रेशन संख्या देगा।
शिकायत रजिस्टर होने के बाद आपके मामले की जाँच की जाएगी व शिकायतकर्ता, राशन दुकानदार व राशन विभाग के अधिकारियों को बुलाकर ADM आपकी शिकायत पर सुनवाई करके लिखित आदेश जारी करेंगे।
आपकी शिकायत मिलने के बाद ADM को 30 दिनों के अंदर मामले पर कार्यवाही व सुनवाई करके आदेश पारित करना होगा।
यदि आपको लगता है कि ADM ने आपकी शिकायत पर ठीक कार्यवाही नहीं की है और आप उसके आदेश से असंतुष्ट हैं तो आप ADM द्वारा मिले हुए आदेश के खिलाफ 30 दिनों के अंदर दिल्ली राज्य खाद्य आयोग में आदेश के विरुद्ध अपील कर सकते हैं।
यह व्यवस्था सरकार ने राष्ट्रीय खाद्य सुरक्षा कानून (NFSA) की धारा 15(1) के तहत की है। अक्सर यह देखने में आया है कि राशन विभाग के अधिकारी गड़बड़ियाँ करने में लिप्त रहे हैं। राशन दुकानदार की राशन विभाग के अधिकारियों के साथ मिलीभगत होती है लिहाजा जब भी राशन विभाग में शिकायत की जाती है तो हमेशा अधिकारी उस मामले को दबाकर रफा दफा कर देते हैं।
इस नई व्यवस्था की अच्छी बात यह है कि जिला शिकायत निवारण अधिकारी (District Grievance Redressal Officer - DGRO) राशन विभाग से न होकर अन्य विभाग से है इसलिए उम्मीद है कि लोगों की शिकायतों को निष्पक्ष रूप से जाँच करके सुना जाएगा व उसका निपटारा किया जाएगा।
हैरानी की बात है कि “Gazette Notification” 23 अगस्त 2013 को जारी किया गया है लेकिन आज तक राशन विभाग ने इस Notification को लोगों के बीच नहीं आने दिया। सरकार द्वारा चलाये जा रहे विभाग के Facebook पेज पर तमाम तरह के फोटो स्वच्छ भारत अभियान को लेकर लगाए गए हैं लेकिन इस जरूरी Notification का कहीं भी ज़िक्र तक नहीं है। यह जानकारी भी हमें सूचना के अधिकार कानून के प्रयोग करने पर प्राप्त हुई है।
इस post के साथ सरकार द्वारा जारी Gazette Notification, राशन विभाग द्वारा जारी ऑफिस ऑर्डर की कॉपी attach है व दिल्ली के सभी जिला शिकायत निवारण अधिकारी/ADM की लिस्ट, उससे संबन्धित राशन दफ्तर एवं शिकायत फ़ारमैट नीचे दिया जा रहा है।

दिल्ली की पुनर्वासित बस्तियों में रह रहे लोग सरकार के रहमों करम पर

शहर के सौंदर्यीकरण या विस्तार के नाम पर सरकार जब झुग्गी झोपड़ी को तोड़ कर कहीं अन्य जगह पर बसाती है तो उस बस्ती को पुनर्वासित बस्ती कहा जाता है। दिल्ली में आज़ादी के बाद से अब तक त्रिलोकपुरी, कल्याणपुरी, सीमापुरी, नन्द नगरी, दक्षिणपुरी, जहांगीरपुरी, नांगलोई, सुल्तानपुरी, बवाना, भलसवा, हस्तसाल जैसी 77 बस्तियों में सरकार ने लोगों को पुनर्वासित किया है। जिसमें लगभग 40 लाख लोग निवास करते हैं।

दिल्ली की पुनर्वासित बस्तियों में रह रहे लोग सरकार के रहमों करम पर हैं क्योंकि इन्हें सरकार ने उस जमीन पर मालिकाना हक़ नहीं दिया है। लोगों के लगातार मालिकाना हक़ के माँग के चलते सन 2013 में दिल्ली सरकार एक स्कीम लेकर आई जिसके तहत सरकार ने पहली बार कुछ शर्तों के साथ सिर्फ 45 बस्तियों में रहने वाले लोगों को ही मालिकाना हक़ देने की बात कही। इस स्कीम में सरकार ने मालिकाना हक़ लेने के लिए लगभग 50,000/- रु से लेकर 23 लाख रु का शुल्क मांगा। ये सरकार की सोची समझी रणनीति थी कि इन बस्तियों में रहने वाले लोग कभी भी मालिकाना हक़ न ले पाए क्योंकि इतनी भारी रकम कोई भी पुनर्वासित बस्ती में रहने वाले लोग नहीं दे सकते हैं, नतीजा यह रहा कि स्कीम के लागू होने के एक साल बाद भी पूरी दिल्ली में सिर्फ 6 लोग इस स्कीम के तहत मालिकाना हक़ ले पाये।

चुनाव नजदीक है इस बात को ध्यान में रखते हुए पारदर्शिता ने इन क्षेत्रों में काम कर रहे संगठनों के साथ इंडिया इंटरनेशनल सेंटर (IIC), नई दिल्ली में 24 दिसम्बर 2014 को एक मीटिंग आयोजित किया। इस मीटिंग में BJP, Congress और AAP के विधायकों को भी आमंत्रित किया गया था। इन सभी पार्टी के लोगों ने आने का वादा भी किया। लेकिन अंतिम समय में BJP और Congress के विधायकों ने चुनावी व्यस्तता का बहाना बनाकर मीटिंग में आने से माना कर दिया।

AAP के वरिष्ठ नेता श्री मनीष सिसोदिया ने इस मीटिंग में अपनी उपस्थिती दर्ज़ की और कहा कि दिल्ली के पुनर्वासित बस्ती के साथ- साथ हमें झुग्गी-झोपड़ी में रहने वाले लोगो के संदर्भ में भी सोचने कि जरूरत है इसलिए यदि पुनर्वासित बस्ती के साथ-साथ झुग्गी-झोपड़ी में रहने वाले लोगों के साथ विचार-विमर्श करके एक कार्यनीति तैयार कि जाये तो आम आदमी पार्टी न केवल उसे अपने Vision Document में जगह देगी बल्कि यदि AAP की सरकार आई तो आते ही उसे तुरंत लागू करेगी।

कार्यक्रम के दौरान सभी संगठन के साथियों ने मिलकर एक कमेटी का गठन किया जो विभिन्न बस्तियों में लोगों के साथ विचार-विमर्श कर तथा सरकार के इस स्कीम व स्लम पॉलिसी का अध्ययन कर सभी साथी पुनः 21 जनवरी 2015 को साथ में बैठेंगे और इस मुद्दे पर एक ठोस कार्यनीति तैयार की जाएगी।

MUMBAI: Fulfilling the responsibility of donating the money to the most deserving Delhiite underRaunac Ki Dilli – 10 lakh tere haath, RED FM donated Rs 10 lakhs to the much deserving participant Shikha. She was felicitated by cricketer Gautam Gambhir in an event held at Ambience Mall on November 26, 2014. Shikha was chosen the winner because of her heroic struggle after being exploited by her father for two years.

RED FM received tremendous response from its listeners in terms of number of stories from the callers. The kind of stories that were aired on the channel were so touching that the listeners were compelled to contact RED FM to extend their help and support. Shikha was chosen to be the winner as hers was the most sensitive case amongst all.

Felicitating the winner at the event, Ms Nisha Narayanan said, "Today, radio has emerged as the most preferred means of communication for the listeners. After several successful events this year, we got the opportunity to run this unique cause-related initiative. The overwhelming response that RED FM has received for Raunac ki Dilli – 10 lakh tere haath has further strengthened our confidence that we moved into the right direction by taking up the responsibility of donating Rs 10 lakhs on behalf of the unknown caller. We are extremely proud to be part of an initiative which helped in changing the life of someone. It is very encouraging for us to have taken a big leap with this first- of --its kind initiative and watching radio turn into a medium for communication and awareness"
After suffering for two years, Shikha filed a complaint against her father. Her father is in jail for the crimes that he had committed but Shikha’s future was in dark until RED FM came forward and decided to give Rs 10 lakhs to help and support her.

Gautam Gambhir who felicitated the winner, has been actively involved in social work. He already has a NGO by the name of ‘Gautam Gambhir Foundation’ which works for the betterment of families of the martyrs of armed forces, underprivileged children especially girls and environmental issues.

8 PENDING CASES - RTI woke up DoE to its complaints

The south district branch of the Directorate of Education probably didn’t know it had complaints at all till a RTI query arrived. Replies to a RTI, filed by NGO Pardarshita on July 15 on the newly-established grievance redress mechanism, show the school district received eight complaints—five of them admission-related—over April May. They addressed none and said, “Since the link (to complaints) was not working the contents of the complaints could not be seen.” This didn’t bother them till July 30—nearly two months after the last complaint was filed—when they wrote to headquarters about it.Pardarshita sought data on the number and nature of complaints filed over April-June and the orders from the District Deputy Directors of Education (DDEs)—the “local authority” to whom complaints are ad dressed—to test how well the system is functioning. Not too well, they’ve found.
Five of eight cases with south district had been admission-related, which, the new guideline asks officials to “endeavour” to resolve in 15 days. “Then the act says the “the local authority shall decide the matter within a period of three moths after affording a reasonable opportunity of being heard to the parties concerned” but we couldn’t find a single instance where anyone was called for a hearing,” says Rajiv Kumar of Pardarshita.
The DDEs weren’t exactly swamped. Just 67 complaints were filed over three months.
The majority of complaints were registered against schools in east and south west B districts (12 each), north west B (10), north east (nine) and south (eight). The count of complaints is under five in the remaining eight school districts. Despite the low burden, the response isn’t satisfactory.
